The second pillar will likely be presented after the summer break and implemented after the first pillar. The government aims to avoid involving the Federal Council in both pillars, but this may be difficult as consent from the Bundesrat may be required for the first pillar. The government also hopes to avoid a notification procedure by the EU Commission for the first pillar, but this is likely unavoidable for the second pillar as it includes commercial activities that could affect the EU market. The key points paper likely exhausts the possibilities under current EU law, and the government aims to promote a progressive, prevention-oriented cannabis policy at the EU level in the long term. However, many questions remain, including the source of supply for cannabis clubs and the organizational and bureaucratic hurdles that need to be overcome.
Germany has issued a decision to regulate the prescription practice of medical cannabis products, with the Joint Committee determining the details of insurance coverage of medicinal cannabis products within six months of the transmission of the results of a non-interventional accompanying survey conducted by the Federal Institute for Drugs and Medical Devices. The main significant change is that before prescribing cannabis in the form of dried flowers or extracts, it must be determined whether other finished medicinal products containing cannabis are available that are suitable for treatment.
